Welcome to Zertoo. These Terms of Service ("Terms") govern your use of Zertoo's websites, applications, and related services (collectively, the "Site" or "Services").

By using the Services, you agree to be bound by these Terms, together with Zertoo's Privacy Policy. If you do not agree, do not use the Services.

Eligibility and General Use

The Services are available only to individuals who are at least 18 years of age and who provide accurate and complete information.

You represent that you are legally permitted to enter into these Terms.

You agree not to use the Services for unlawful purposes or in violation of applicable laws.

Payment Information

To make purchases through Zertoo, you must provide valid credit card details or another accepted payment method.

You authorize Zertoo to charge any valid payment method on file.

You agree to promptly update your account information with any changes (billing address, card number, expiration date).

Your card issuer agreement governs your use of your payment method.

Disputes must be raised within 30 days.

Shipping and Delivery

Shipping times are estimates only and not guaranteed.

Risk of loss and title to goods passes to you when you or your designated recipient takes possession of the shipment.

Zertoo is not responsible for delays caused by carriers, customs, or unforeseen events.

Returns and Refunds

Physical products purchased may be returned within 30 days of delivery in accordance with Zertoo's Refund Policy.

If a product is defective or mis-shipped, Zertoo will arrange an appropriate remedy.

Communications

You consent to receive communications from Zertoo electronically.

You may update your communication preferences through your account.

For SMS, reply STOP to opt out.

Digital Content

Where you purchase or access digital content supplied immediately, your statutory right to withdraw may not apply once the supply has begun, unless defective.

Account Security

You are solely responsible for preserving the confidentiality and security of your Zertoo account.

Notify us immediately if you become aware of unauthorized access.

Zertoo is not liable for losses due to unauthorized use.

Intellectual Property

All content, layouts, logos, graphics, and trademarks are the property of Zertoo or its licensors.

You may not reproduce, distribute, or create derivative works without written consent.

Prohibited Uses

Prohibited uses include, but are not limited to:

• Attempting to access another user's account
• Introducing viruses or malicious code
• Data mining, scraping, reverse engineering, or exploiting bugs
• Infringing intellectual property rights

Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis, without warranties of any kind.

Zertoo does not warrant that the Services will be error-free, secure, or uninterrupted.

Liability for third-party content, technical errors, and unauthorized access is disclaimed.

Some jurisdictions do not allow limitations on implied warranties; these exclusions may not apply to you.

Limitation of Liability

To the maximum extent permitted by law, Zertoo shall not be liable for indirect, incidental, or consequential damages (including lost profits, data, goodwill).

Aggregate liability is limited to $100 USD or the total fees paid in the past 12 months, whichever is greater.

Indemnity

You agree to defend, indemnify, and hold harmless Zertoo, its affiliates, officers, employees, and agents from claims, liabilities, and expenses arising from:

• Your use of the Services
• Your violation of these Terms
• Your infringement of third-party rights

Sales and Taxes

Zertoo reserves the right to charge sales tax, VAT, GST, or other duties where required by law.

Modification and Termination

Zertoo may update these Terms at any time.

Continued use of the Services after changes constitutes acceptance.

We may suspend or terminate your access if you violate these Terms.

Dispute Resolution

Disputes will be resolved through binding arbitration under the rules of the American Arbitration Association.

Arbitration will take place in Broward County, Florida, unless otherwise agreed.

You may opt-out of arbitration within 30 days of accepting these Terms by sending written notice.

Arbitration costs will be shared unless ruled otherwise.

Small claims court remains an option.

Class actions and consolidated proceedings are waived.

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Florida. Courts in Palm Beach County, Florida, have exclusive jurisdiction for disputes not subject to arbitration.

Force Majeure

Zertoo shall not be liable for delays or failures caused by events beyond reasonable control, including:

• Natural disasters
• Strikes
• Government actions
• Internet outages

Severability and Waiver

If any provision is found unenforceable, the remaining provisions remain valid.

Failure to enforce any provision does not constitute a waiver.

Entire Agreement

These Terms constitute the complete agreement between you and Zertoo, superseding prior agreements.
